Abortion Pill Mifepristone Notice

Last Updated August 16, 2023:  The commonly known “abortion pill” is a two-step process, consisting of two FDA approved drugs, mifepristone and misoprostol. Mifepristone is used to end the pregnancy and misoprostol is used to expel the fetus from the body.

In February 2023, The Alliance for Hippocratic Medicine sued the FDA, claiming mifepristone, also known as “RU486” and “Mifeprex”, was rushed through FDA approval and not properly tested.

The 5th US Circuit Court of Appeals has upheld this ruling on the restriction of Mifepristone, commonly known as the “abortion pill”. The 5th US Circuit Court of Appeals ruled that the 2000 approval of Mifepristone by the FDA was unlawful and that it causes harm to girls and women, by relaxing restrictions and the approval process of the drug. The decision will also impact access to the “abortion pill”, limiting the window for dispensing the drug from 10 weeks to seven weeks and requiring that it be available only by prescription.

The Supreme Court will now hear and determine the final ruling for the case. It is expected that the Supreme Court will not reach a decision on this case until 2024 or 2025. Until the final ruling from the Supreme Court, there will be no change in how the drug is distributed and the ruling from the 5th US Circuit Court of Appeals will not go into effect.
